Terms of Use
These Terms of Use (âTermsâ) apply to all participants in our Programs or users of our website. By accessing our Programs or using our website, you agree to be bound by these Terms as well as any and all general Terms & Conditions posted on our website from time to time.

Definitions
âProgramsâ means collectively the Courses, Training, Community and Content provided by Neurodivergent Education or Kate Donohue from time to time.
âCommunityâ means any online or in-person forum, group, discussion space or network made available to participants as part of our Programs, including but not limited to private online groups, community platforms, and any peer or facilitated interaction spaces provided by Neurodivergent Education or Kate Donohue from time to time.
âContentâ means any and all material provided as part of our Programs, including but not limited to videos, audio recordings, text, images, workbooks, assignments, interactive activities, templates, guides, resources, downloadable files and any other materials delivered or made accessible in connection with a Course or Training, whether in digital or other format, as updated from time to time.
âCourseâ means a structured program of Content, accessed online and designed to provide participants with specific skills and knowledge of a subject.
âTrainingâ means any live, recorded or interactive learning session, workshop, webinar, coaching or mentoring session, or other educational program delivered by Neurodivergent Education or Kate Donohue, whether in person or online.
âWeâ, âourâ and âusâ means Neurodivergent Education, neurodivergenteducation.com.au and includes all officers, directors, employees, contractors and affiliates.
âYouâ and âyourâ means any participant in our Programs or user of our website.

Password Use and Security
By accessing our Programs, You acknowledge that the Programs are for Your exclusive use only, or if it is a parenting Program, by the childâs parents or primary caregivers. Use or sharing of Your User Name and Password by another user is not permitted and is cause for immediate termination of this Agreement without notice to You.
You are solely responsible for maintaining the confidentiality of Your User Name and Password and for all activities that occur under Your User Name and Password. You agree to immediately notify [email protected] if You become aware of or have reason to believe that there is any unauthorised use of Your account or any other breach of security. You also agree to take all reasonable steps to stop such unauthorised use and to cooperate with Neurodivergent Education in any investigation of such unauthorised uses or of infringements of Neurodivergent Educationâs intellectual property rights in the Programs. Neurodivergent Education shall have the sole right, at its expense, to bring any action on account of such infringements or unauthorised uses. Neurodivergent Education is in no way liable for any claims related to the use or misuse of Your User Name and Password due to the activities of any third party outside of our control or due to Your failure to maintain their confidentiality and security.

License
Upon acceptance of these Terms, we hereby grant you a non-exclusive, non-transferable, limited licence to access and use our Programs.
Our Programs may only be used for your own individual, personal, non-commercial use.
You may view, browse and search our Content but only store, download or print a maximum of one copy of our Content for your own personal use.
You agree not to modify, alter, disassemble, decompile, translate or convert into a human-readable form or reverse engineer all or any part of our Programs.
You agree not to share, sell, licence or distribute any of our Programs to third parties or use our Programs in any part or whole, in any commercial venture, business or package or in any way for sale, licence or distribution without our written consent.
You agree not to store or use our Programs in any database or other storage facility, in either paper or electronic form, which is meant to provide public access to knowledge or information.
You agree not to in any other way reproduce, copy, download, scrape, store, publish, transmit, re-transmit, transfer, communicate, distribute, disseminate, broadcast, circulate, sell, resell or otherwise use our Programs or any part or portion of our Programs in any form or by any means.
Any unauthorised use of our Programs will result in your Licence being terminated and may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.
We reserve the right to disclose your name and any other personal details to any law enforcement authority or other competent authority or to any person for the purpose of legal proceedings, prosecution, investigation or any breach or alleged breach of the law or these Terms.

Our Programs and any related resources provided are for educational and general information purposes only and should not be considered professional advice.
We do not know your personal circumstances when providing this information and it does not constitute, nor should it be treated as personal, legal, business, tax, financial or other advice of any type or nature.
You need to make your own enquiries and analysis to determine if any of the information is suitable for your own particular purposes and suitable for your situation and requirements.
We do not promise, warrant or guarantee any particular results from any of our Programs or information.
Results vary from individual to individual and the performance, progress and success of any Programs will depend on your own situation, participation and factors beyond our control.
The Content presented in our Programs is obtained from sources believed to be reliable and is given in good faith but its accuracy and completeness are not warranted, nor do we accept responsibility arising in any way from the data or information, including but not limited to negligence, errors or omissions.

Liability
You agree and acknowledge that we are not liable for any direct, indirect, consequential or incidental loss or damage which may result from you accessing our Programs or any information contained on our website or linked from it.
You agree that any actions you may take or decisions you may make based on information in our Programs or on our website are made at your own risk and we cannot be held liable for any results or outcomes.
Your use of the information in our Programs is entirely at your own risk and any reliance on the information should be your own decision or done with the help of a professional advisor.
For the sake of clarity, in no event will we be liable for any direct, indirect, consequential, incidental or special damages of any kind including any damages for loss or injury.
We will not be held liable for any issues related to internet connectivity or technical difficulties experienced by you while accessing the Programs.
Certain legislation, including the Australian Consumer Law (âACLâ) in the Consumer and Competition Act 2010 (Cth) and similar consumer protection laws and regulations, may confer you with rights, warranties, guarantees and remedies relating to the provision of services by us to you which cannot be excluded, restricted or modified (âStatutory Rightsâ).
Our liability is governed solely by the ACL and these Terms. We exclude all conditions and warranties implied by custom, law or statute except for your Statutory Rights.

Fees and Payments
Neurodivergent Education will charge registration (subscription) fees for access to Programs and may change the fees at any time. When fees are changed, Neurodivergent Education will notify You by e-mail, by posting a notice on the Site, or by any other reasonable form of notification. The fee options available to You will be presented within the program descriptions and at the point of registration. Access to Programs will be available for the registration term specific to each program type as stated in the program descriptions following completed payment for the training. Your access to Programs will be terminated at the end of the term in effect.
You agree to pay all registration fees and other charges that may be incurred in connection with Your User Name and Password (including any applicable taxes) at the rates in effect when the charges were incurred.
All fees and charges incurred in connection with Your User Name and Password are your responsibility and will be billed to You.
You also are responsible for any charges incurred to access the Programs, such as telephone and other equipment charges, and fees charged by an Internet access provider or other third-party service.
Invoices for any Neurodivergent Education program are automatically generated and can be requested at any time by emailing [email protected].
- Most of our payments are operated through an online and automated billing system. Where your payments are made via Online Payment:
You agree to ensure sufficient funds are available in your nominated account to meet any account withdrawals made by us on their scheduled due dates. - If payment is defaulted or not received, you authorise us to debit any outstanding funds from your nominated account without need for notification at a future date.
Where another agent or enterprise is debiting funds pursuant to an arrangement entered into with us, you also affirm the same rights and undertakings explained in these Terms to them.
We reserve the right to suspend or terminate any product or service, at our discretion, if payment is defaulted.
We reserve the right to on-sell or otherwise authorise a debt-collection or other authorised agency to collect any amount not paid by you.
We reserve the right to inform credit watch monitoring services of ongoing defaults trends or payment-avoiding strategies employed where we deem it appropriate.
We endeavour to work with clients who have financial difficulties to ensure actions such as those listed above do not happen. If you are having difficulties or require a payment plan, please contact us.
In circumstances where we invoice you for payment, payment is due and payable by the payment date noted on the invoice. Failure to make payment by the payment date may lead to suspension of use of our product and/or services.
From time to time, Neurodivergent Education may offer members the opportunity to purchase additional products and services at a discounted rate. To be eligible for this discount, you must be an active member in good standing at the time of purchase.

Refunds and Cancellation
Courses with one-time payments:
We do not offer refunds for the Course and/or Content, whether accessed or not, unless we are in breach of the Australian Consumer Law, as set out in Schedule 2 to the Australian and Competition Act 2010 (Cth).
We reserve the right to change or update our Programs, pricing and refund policy at any time and without notice.
Courses with month-to-month or annual subscriptions:
We do not offer refunds for payments made on our month-to-month or annual subscription plans (âSubscriptionâ).
Your Subscription will continue on a month-to-month or annual basis unless and until you cancel or the Subscription is suspended or discontinued by us.
If you wish to cancel your subscription, you will need to email [email protected] with 30 daysâ written notice.
If you cancel your Subscription, the cancellation will be effective at the end of the current monthly or annual period, you will continue to have access to our Programs for the remainder of that period, but you will not receive a refund.
Please note that if you have purchased the Dynamic Parenting Course on a monthly subscription, you will retain lifetime access to the purchased course after 6 monthly payments.
We reserve the right to change or update our Programs, Subscription plans, refund and cancellation policy at any time and without notice.
Any changes to your Subscription plan will take effect following notice to you for the months after your next payment.

Lifetime Access
Upon enrolment, participants are granted lifetime access to the course materials. âLifetime accessâ refers to the continued availability of the course content for as long as the course remains hosted and supported by Neurodivergent Education.
This access includes all core learning materials, modules, and downloadable resources that are part of the course at the time of purchase. From time to time, course content may be updated or modified to maintain relevance or accuracy. Access to future updates is at the discretion of Neurodivergent Education.
While we make every effort to maintain access indefinitely, we reserve the right to discontinue or retire the course if necessary (for example, due to platform changes, business closure, or other unforeseen circumstances). In such cases, participants will be given reasonable notice wherever possible.
Lifetime access is provided for personal, non-transferable use only, and may not be shared, copied, or redistributed in any form.

Governing Law
These Terms are governed by the laws from time to time in force in SA of Australia.
Both parties agree to unconditionally submit to the exclusive jurisdiction of the Courts of SA for determining any dispute concerning these Terms.
